These Terms of Use (“Terms”) govern your access to and use of the digital content and services (“Services”) provided by FreshVisuals (“we,” “us,” or “our”). By subscribing, downloading, or using any content from FreshVisuals, you agree to be bound by these Terms. If you are acting on behalf of an organization, you represent that you have authority to enter into this agreement on its behalf.
1. License, Not Ownership
All digital materials provided by FreshVisuals are licensed, not sold. This means you are granted specific rights to use the content, but we retain full ownership of all files and intellectual property.
Upon purchase or subscription, FreshVisuals grants you a limited, non-exclusive, non-transferable, revocable license to use the content in accordance with these Terms.
2. Who This Is For
Our services are designed for churches, nonprofits, and similar organizations. You may use our content during worship services, online broadcasts, social media posts, or in-house presentations—depending on your license tier.
"FreshVisuals Single" license: For use in one physical location or church campus.
"FreshVisuals Multi" license: Covers multiple campuses or online church networks.
3. What You Can and Cannot Do
🤗 Permitted Uses:
-Display content during services, sermons, or events.
-Use in livestreams, podcasts, or online church platforms.
-Share internally within your organization, staff, or media team.
😭 Prohibited Uses:
-Redistributing or reselling the content.
-Offering content as part of stock libraries or template bundles.
-Uploading, sharing, or storing FreshVisuals content on shared drives or platforms accessible to other organizations.
-Using content for commercial resale or licensing without written permission.
-If we discover that your use goes beyond the license granted, we reserve the right to suspend or revoke access without refund.
4. Subscription Terms
Our Services are offered through recurring monthly or annual plans. Annual subscriptions are offered at a discounted rate. Your subscription will automatically renew unless canceled before the renewal date.
Because access is digital and instant, all purchases are non-refundable.
We reserve the right to:
-Modify subscription tiers or features.
-Add or remove content from our platform.
-Adjust pricing with notice posted on our website or via email.
5. Content Ownership
All videos, graphics, and visual designs remain the intellectual property of FreshVisuals or its licensors. You may not alter, decompile, or attempt to extract source files unless expressly permitted in writing.
You may not create derivative works for distribution or commercial use unless expressly permitted in writing. All rights not explicitly granted in these Terms are reserved by FreshVisuals.
6. Termination of Use
You may cancel your subscription at any time. Upon cancellation:
-You may continue using visuals in previously released productions or livestreams.
-You may not use content in any new or future projects, recordings, or livestreams.
-You agree to delete all downloaded materials from your devices, servers, or cloud storage upon cancelation or when your yearly or monthly plan ends.
We may terminate your access immediately, without notice, if you breach these Terms or misuse our Services. We may also suspend access for investigation if misuse is suspected.
7. User Responsibilities
You are responsible for:
-Maintaining the security of your login credentials.
-Ensuring content is only used by your team or approved staff within your organization.
-Complying with applicable copyright, broadcast, and intellectual property laws when using our assets.
-You may not allow contractors, volunteers, or partner churches to access or use FreshVisuals content unless they are part of your official subscription account and within your specific organization.
8. Limitation of Liability
FreshVisuals provides content “as is,” without warranties of any kind—express or implied.
We are not liable for:
-Any indirect or consequential damages.
-Loss of data, business interruption, or service interruptions.
-Errors in content or delays in availability.
To the maximum extent permitted by law, our total liability for any claim will not exceed the total amount paid by you in the 12 months preceding the claim.
9. Governance of Resolution
These Terms shall be governed by and interpreted according to the laws of the State of Arkansas, without regard to conflict-of-law principles. Any dispute arising from these Terms will be resolved through binding arbitration in Benton County, Arkansas.

We may update these Terms occasionally. Continued use of our Services after changes to terms means you agree to the updated Terms.
